I. Terms and Conditions
§ 1 Basic Provisions

The following terms and conditions apply to contracts that you conclude with us as the provider (TELOSMART) via the website telosmart.com. Unless otherwise agreed, we object to the inclusion of any terms you may use that differ from these.

A "consumer" within the meaning of the following provisions is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business, or profession. An "entrepreneur" is any natural or legal person or a legally capable partnership that, when entering into a legal transaction, acts in the exercise of their trade, business, or profession.
§ 2 Conclusion of the Contract

The subject of the contract is the sale of goods.

By listing the respective product on our website, we are making you a binding offer to conclude a contract under the terms stated in the item description via the online shopping cart system.

The contract is concluded through the online shopping cart system as follows: The goods intended for purchase are placed in the "shopping cart." You can access the "shopping cart" via the corresponding button in the navigation bar and make changes at any time. After clicking the "Checkout" or "Proceed to Order" button (or similar wording) and entering personal data as well as payment and shipping terms, the order data will be displayed as an order overview.
If you choose an instant payment system (e.g., PayPal (Express/Plus/Checkout), Amazon Pay, Sofort, giropay), you will either be directed to the order overview page in our online shop or to the instant payment provider's website. If you are redirected to the instant payment system, make the appropriate selection or enter your data there. Finally, you will be shown the order data as an order overview either on the instant payment provider’s website or after returning to our online shop.
Before submitting the order, you have the opportunity to review and change the information in the order overview or cancel the order using the browser’s "back" function.
By submitting the order via the corresponding button ("order with payment obligation," "buy," "place order," or similar wording), you make a binding acceptance of the offer, thus concluding the contract.
- The processing of the order and transmission of all necessary information related to the contract conclusion will take place via email, some of which will be automated. Therefore, you must ensure that the email address you provide is correct and that the receipt of emails is not technically prevented, especially by SPAM filters.
§ 3 Special Agreements Regarding Payment Methods
- Payment via "PayPal" / "PayPal Checkout": If you select a payment method processed via "PayPal" / "PayPal Checkout," the payment will be processed by the payment service provider PayPal (Europe) S.à.r.l. et Cie, S.C.A. (22-24 Boulevard Royal L-2449, Luxembourg; "PayPal"). The available payment methods via "PayPal" are shown on a corresponding button on our website and during the online order process. "PayPal" may use additional payment services for processing; if special payment conditions apply, you will be notified separately. § 4 Right of Retention, Retention of Title

You may only exercise a right of retention if it concerns claims arising from the same contractual relationship.

The goods remain our property until full payment of the purchase price.
§ 5 Warranty

Statutory liability for defects applies.

As a consumer, you are requested to check the goods for completeness, obvious defects, and transport damage immediately upon delivery and to notify us and the carrier of any complaints as soon as possible. Failure to do so does not affect your legal warranty rights.

If a characteristic of the goods deviates from the objective requirements, the deviation is only deemed agreed if you were informed of it before submitting the contractual declaration and the deviation was explicitly and separately agreed between the parties.
§ 6 Choice of Law

German law applies. For consumers, this choice of law only applies insofar as it does not deprive the consumer of the protection provided by mandatory legal provisions of the country of their usual residence (principle of favorability).

The provisions of the UN Convention on Contracts for the International Sale of Goods do not apply.

We are neither willing nor obliged to participate in dispute resolution proceedings before consumer arbitration boards.

The technical steps for contract conclusion, the actual contract conclusion, and the correction options are carried out according to the provisions on "Conclusion of the Contract" in our Terms and Conditions (Part I).
- Contract Language, Storage of Contract Text
3.1. The contract language is German.
3.2. The full contract text is not stored by us. Before submitting the order via the online shopping cart system, the contract data can be printed or electronically saved using the browser’s print function. After receiving your order, we will send you the order data, the legally required information for distance contracts, and the Terms and Conditions again via email.

The essential features of the goods and/or services can be found in the respective offer.
- Prices and Payment Terms
5.1. The prices listed in the respective offers and the shipping costs represent total prices. They include all price components, including all applicable taxes.
5.2. Shipping costs are not included in the purchase price and are displayed separately during the ordering process unless free shipping is offered.
5.3. The available payment methods are listed on our website or in the respective offer.
5.4. Unless otherwise specified, payment claims from the concluded contract are due immediately.
- Delivery Conditions
6.1. Delivery conditions, delivery date, and any existing delivery restrictions can be found on our website or in the respective offer.
6.2. If you are a consumer, the risk of accidental loss or deterioration of the sold goods during shipment passes to you upon receipt, regardless of whether the shipment is insured or not. This does not apply if you have independently commissioned a carrier not named by the entrepreneur.

Liability for defects is governed by the "Warranty" section of our Terms and Conditions (Part I).
