I. Terms and Conditions

§ 1 Basic Provisions

(1) The following terms and conditions apply to contracts concluded with us as the provider (Stefan Cheung) via the website telosmart.com. Unless otherwise agreed, any terms and conditions you may use are expressly rejected.

(2) A consumer within the meaning of the following regulations is any natural person who enters into a legal transaction for purposes that are predominantly outside their commercial or independent professional activity. An entrepreneur is any natural or legal person or a legally responsible partnership who, when entering into a legal transaction, acts in the course of their independent professional or commercial activity.

§ 2 Conclusion of the Contract

(1) The subject of the contract is the sale of goods.

(2) By placing the respective product on our website, we make you a binding offer to conclude a contract under the conditions specified in the item description via the online shopping cart system.

(3) The contract is concluded via the online shopping cart system as follows:
The goods intended for purchase are placed in the "shopping cart." Via the corresponding button in the navigation bar, you can access the "shopping cart" and make changes at any time.
After clicking the "Checkout" or "Proceed to order" button (or similar), entering your personal data and payment and shipping conditions, your order data will be displayed again as an order overview.
If you use an instant payment system (e.g. PayPal (Express/Plus/Checkout), Amazon Pay, Sofort, giropay), you will either be directed to the order overview page in our online store or to the website of the provider of the instant payment system.
If redirected, please make the appropriate selection or enter your data. The order overview will then be displayed either on the payment provider’s website or after you are redirected back to our online store.
Before submitting the order, you have the opportunity to review and modify the order data or cancel the order.
By submitting the order via the appropriate button ("place binding order," "buy" / "buy now," "place order with obligation to pay," "pay" / "pay now" or similar), you declare your legally binding acceptance of the offer, whereby the contract is concluded.

(4) Order processing and transmission of all necessary information in connection with the contract conclusion is carried out by email, partly automated. You must therefore ensure that the email address you provide is correct and that receipt of emails is technically ensured and not blocked by spam filters.

§ 3 Special Agreements on Offered Payment Methods

(1) Payment via "PayPal" / "PayPal Checkout"
If you select a payment method offered via "PayPal" / "PayPal Checkout," payment processing is handled by the payment service provider PayPal (Europe) S.à.r.l. et Cie, S.C.A., 22-24 Boulevard Royal, L-2449 Luxembourg. The individual payment methods via PayPal will be displayed to you on our website and during the order process. § 4 Right of Retention, Retention of Title

(1) You may only exercise a right of retention if it concerns claims from the same contractual relationship.

(2) The goods remain our property until full payment of the purchase price.

§ 5 Warranty

(1) The statutory warranty rights apply.

(2) As a consumer, you are requested to check the goods for completeness, visible defects, and transport damage immediately upon delivery and to notify us and the carrier of any complaints as soon as possible. Failure to do so has no effect on your statutory warranty claims.

(3) If a feature of the goods deviates from the objective requirements, this deviation is only considered agreed if you were informed about it before submitting your contractual declaration and the deviation was expressly and separately agreed between the parties.

§ 6 Governing Law

(1) German law applies. For consumers, this choice of law only applies to the extent that the protection granted by mandatory provisions of the law of the consumer's habitual residence is not withdrawn (principle of favorability).

(2) The provisions of the UN Convention on Contracts for the International Sale of Goods (CISG) do not apply.

3. Contract Language, Storage of Contract Text

3.1. The contract language is German.

3.2. The complete contract text is not stored by us. Before submitting the order via the online shopping cart system, the contract data can be printed or electronically saved using the browser's print function. After receiving the order, the order data, legally required information for distance contracts, and the terms and conditions will be sent to you by email.

5. Prices and Payment Terms

5.1. The prices listed in the respective offers and shipping costs represent total prices. They include all price components including all applicable taxes.

5.2. Shipping costs are not included in the purchase price. They can be accessed via a designated button on our website or in the respective offer, are separately listed during the order process, and must be borne by you unless free shipping is promised.

5.3. The available payment methods are shown via a designated button on our website or in the respective offer.

5.4. Unless otherwise stated for the individual payment methods, payment claims from the contract are due immediately.

6. Delivery Conditions

6.1. Delivery terms, delivery date, and any delivery restrictions can be found on a designated button on our website or in the respective offer.

6.2. If you are a consumer, the law provides that the risk of accidental loss and accidental deterioration of the sold item during shipment does not pass to you until the item is handed over to you, regardless of whether the shipment is insured. This does not apply if you have independently commissioned a carrier not named by the entrepreneur or a person otherwise designated to carry out the shipment.

7. Statutory Warranty Rights

The warranty is based on the regulation "Warranty" in our General Terms and Conditions (Part I).
